POLLING DISTRICTS
Article 22
1. In the election for the Presidency of the Republic, voting shall be held in permanent polling districts established on the territory of a commune on the basis of the provisions of the Act of 16th July 1998 - on Elections to the councils of communes, councils of districts and assemblies of voivodships (Dziennik Ustaw No. 95, item 602 and No. 160, item 1060) and subject to the provisions of paras 3 and 4.
2. Changes in the division into polling districts, if such necessity results from changes in the boundaries of a commune or the number of inhabitants of the commune, shall be enacted in accordance with the principles and procedures specified by the Act referred to in para. 1, no later than the 45th day before the election day.
3. Polling districts shall be established in hospitals, social welfare establishments, if at least 50 electors shall reside therein on the election day and, in the event that such number is less than so required, a polling district may be established after seeking the opinion of the head of the hospital or social welfare establishment.
4. Polling districts shall be established for electors staying in penal institutions and places of remand, as well as in extramural departments of these establishments. Any departure from this obligation shall be possible only in justified cases on request of the head of a penal institution or place of remand.
5. The council of a commune, on request of the head of the commune (mayor, president of town), shall establish polling districts, referred to in paras 3 and 4, and shall specify their consecutive numbers and boundaries as well as the locations of district electoral commissions. Such districts shall be established no later than the 45th day before the election day.
6. After ineffective expiry of the time-limit referred to in para. 5, the actions listed in that provision shall be performed by the appropriate voivod no later than the 42nd day before the election day.
Article 23
1. Polling districts shall be established for Polish citizens staying abroad.
2. The polling districts referred to in para. 1 shall be established by the minister competent for matters of foreign affairs, in agreement with the National Electoral Commission, who shall specify the locations of district electoral commissions. The results of voting in these districts shall be transmitted to the regional electoral commission appropriate for the commune of Warsaw-Centrum.
3. Polling districts shall be established for electors staying aboard Polish ships continuing their voyage during the period comprising the day of elections, if there are at least 15 voters present aboard and there is an opportunity to transmit to the appropriate regional electoral commission the results of the voting immediately after its conclusion.
4. For the purposes of this Act, a Polish ship is a ship wholly owned by a Polish shipowner that has his seat in Poland, carries the Polish flag and is under command of a Polish captain.
5. Polling districts referred to in para. 3 shall be established by the minister competent for maritime economy affairs in agreement with the National Electoral Commission, at the request of the shipowner, made no later than the 30th day before the elections. The results of voting in these districts shall be transmitted to the regional electoral commission appropriate for the seat of the shipowner.
Article 24
1. Information on the consecutive numbers and the boundaries of polling districts, as well as on the location of district electoral commissions shall be made public by the head of a commune (mayor, president of town) posting announcements no later than the 35th day before the election day.
2. The obligation, referred to in para. 1, in respect of polling districts established abroad, shall be discharged by consuls. This obligation shall be fulfilled no later than the 21st day before the election day.
3. The captain of a ship shall notify the voters on the establishment of a polling district aboard ship.
